This privacy policy (“Policy”) describes the personal data collected or generated (processed) when you use our website(s) (“Site” or “Sites”). It also explains how your personal data is used, shared and protected, what choices you have relating to your personal data and how you can contact us. This policy applies to personal information processed by or on behalf of Suditi Sports Apparel Limited (“NBA Store India”). We share some of your information with the NBA who shall be the data fiduciary of that data shared with them. Their privacy policy sets out how they will use this information.

We are Suditi Sports Apparel Limited, a Company incorporated and registered under the provisions of the Companies Act, 2013 and having its registered office at C-3B, MIDC, TTC Industrial Area, Navi Mumbai – 400705 and operating in India as the official service provider for NBAStore.in (“NBA Store India”). Privacy and security of your personal information is our priority. We assure you that the user or customer information collected through accessing, using, browsing or otherwise of the instant website, is safe, kept on a secure server and fully compliant with all of the relevant consumer laws. All payment transactions are made only through encrypted SSL technology. This Privacy Policy is published in accordance with Rule 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information or Data) Rules, 2011 read with Rule 3(1) of the provisions of Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

We agree with all users to not send out information that goes against your consent, our terms and conditions, subject matter or data sent unless required by the law to do so.

What user or customer information does NBA Store India collect?

NBA Store India collects your contact details such as customer name, email address, account password, phone number, date of birth and shipping address. Further, your personal information sent through Live Chat, IM, phone calls, e-mails, text messages or any other types of communication platforms used by us may be recorded and collected by us.

Your transaction or banking details such as credit/debit card number, cardholder name, expiration date and CVV and/or other information as required for internet banking or other payment instruments is not held by NBA Store India but is held by our Payment Gateway partner (Razorpay or any other payment gateway partners that NBA Store India chooses to work with). Our payment gateway partner is "PCI-Compliant" which ensures the highest standards of protection and security for your information.

We also collect information pertaining to your previous orders and transactions including the product and pricing details, the date of purchase, transaction information, payment history etc.

Information from optional online surveys on our and/or third-party sites (posted by NBA Store India) which may include demographic information (like gender, age, income) as well as product and service preferences of users, is also collected by us.

Other information collected by us may include, but are not limited to, IP addresses, browser types, domain names, access times and referrals to our Site. The collected information is used to make site improvements and generate statistics and metrics relating to our Site.

We also receive information about you from the NBA.

Why and how do we use your personal data?

We will use your personal data to offer the requested product or service when you use our Sites. For instance, if you make a purchase on NBA Store India or take part in an event or promotion, we will contact you using the contact information you provide to discuss the purchase, event, or promotion. We use most of the information provided by users to fulfil orders and deliveries requested by users.

NBA Store India does not sell, rent or lease its clients or customer information/lists to any outside or unaffiliated third parties. This includes information such as e-mails, names, addresses, telephone numbers, etc. NBA Store India may share data with trusted partners as part of ongoing measures for site maintenance and improvement. All NBA Store India affiliated third parties are prohibited from using the personal information provided to them except to fulfil their required services to us. They are prohibited from sending or sharing any of the information provided to them with outside parties unless authorized by us.

NBA Store India will disclose personal, sensitive information without notice, to the Indian Government or its instrumentalities only if such disclosure is required by applicable law. As an established business, a customer’s information may need to be disclosed for such purpose.

For NBA to send You direct marketing in accordance with the preferences you select when you sign up to receive updates or purchase products. If you have consented to NBA sending you direct marketing, once we have notified NBA of this consent, you may withdraw this consent by clicking on the unsubscribe link in any communication from NBA, or as set out in NBA’s privacy policy.

To share your information with NBA

This means that although we control this Site and sell the products you purchase directly to you (including managing all aspects of fulfilment), we have been asked to do so by NBA and are licensed to use their brand. As a part of that relationship, we share details of customers of NBA products. NBA will use your personal data in accordance with their privacy policy and you can contact them directly with any questions by emailing the relevant contact set out in their privacy policy.

For general research and analysis purposes

To better understand customer behaviour or preferences, we use data about how visitors use our Site. For instance, we may use data regarding product searches and product discovery on our Site to better comprehend how to arrange and display product options in our marketplace.

Our relationship with Shopify

Our Site is hosted by Shopify, which collects and processes personal information about your use of the Site in order to provide and improve it. We also use certain Shopify features that use information about your interactions with our store, other merchants and Shopify. Data that is collected automatically

• We automatically collect information pertaining to your IP Address when you visit our Sites for maintaining our records. This information helps us to make improvements to our content and navigation.

Data storage and transfer

Our Site is hosted by Shopify, and your information is stored and processed by Shopify and our other service providers on servers that may be located outside India, including in Canada, the United States and Singapore. By using the Site, you understand and agree that your information may be collected in India and transferred to, stored in and processed in such other countries as described in this Policy, in accordance with applicable data protection laws, including the Digital Personal Data Protection Act, 2023. We take reasonable steps to ensure that your information remains protected in line with this Policy and the laws of India, which may not be equivalent to those of your home country.
